Big Moments Company: Terms of Service

Welcome to Big Moments Company. These Terms of Service (“Terms”) are the agreement between you and Big Moments Company (“Big Moments,” “we,” “us”) that governs your use of our website, plans, memberships, and services.

By using our website, purchasing a plan, joining a membership, redeeming a gift, submitting a questionnaire, or creating an account, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use our services.

1. What We Do

Big Moments Company creates personalized planning services for relationship moments: date night plans, birthday plans, anniversary plans, proposal plans, vacation and trip plans, keepsake scrapbooks, and related memberships, games, and tools.

Every plan is drafted with the help of software and AI tools and reviewed by a real person before it reaches you. Our plans are personalized suggestions and recommendations. What you do with them (where you go, what you book, what you spend) is always your decision.

2. Who Can Use Big Moments

You must be at least 18 years old to purchase our services or create an account. By using Big Moments, you confirm that you are 18 or older and able to enter into this agreement.

When our questionnaires ask about other people (your partner, your family, who's joining a trip), you're responsible for having the right to share that information, and for sharing only what's reasonably needed for your plan.

3. Your Account

Member sign-in is passwordless: we email a one-time sign-in link to your account email. That means your account is as secure as your email inbox: keep your email account protected, and use an address only you can access if your plans are a surprise.

You're responsible for activity that happens through your account. Tell us right away at questions@bigmomentscompany.com if you believe someone else has accessed it.

4. Purchases, Memberships, and Billing

Payments are processed by Stripe. By purchasing, you authorize the charge for your one-time plan or the recurring charge for your membership.

Memberships renew automatically each billing period (monthly, or yearly for annual plans) until you cancel. You can cancel anytime from your dashboard; cancellation takes effect at the end of your current billing period, and you keep access until then.

Founding-member pricing

Founding-member pricing locks your membership rate: as long as your subscription remains active and uninterrupted, your recurring price will not increase. The rate lock applies to the price only. Features, perks, games, and promotional extras are not part of the rate lock and may be added, changed, or retired as the product evolves.

Limited-time perks (for example, the founding-member free vacation plan) are promotional. We'll honor any plan already requested under a promotion, but we may end the promotion for future requests at any time.

Membership allowances

Some membership features come with allowances, such as monthly date plans, keepsake scrapbooks, or the Premium + Getaways vacation plan (one per calendar quarter). Allowances are use-it-in-the-period benefits: they don't roll over, accumulate, or convert to credit or cash. A vacation plan that we discard before delivery, or that fails to generate, does not count against your allowance.

Refunds

Because every plan is custom-built for you, plans are non-refundable once delivered. This applies to one-time plans (birthday, anniversary, proposal) and to plans delivered under a membership (monthly dates, vacation plans).

Membership fees for a billing period already started are non-refundable; cancel anytime to stop future charges. If something went genuinely wrong with your order, email us; a real person reads every message, and we'd rather make it right than argue.

Gift codes

Gift purchases are delivered as codes the recipient redeems. Gift codes aren't redeemable for cash, and a gift purchase is refundable only before the code has been redeemed.

5. Plans Are Suggestions: Verify Before You Go

We work hard to recommend real, specific, currently-operating places, and we verify details like hours and prices while building your plan. But the world moves: restaurants close, hours change, prices rise, events sell out, weather happens.

Details in your plan (prices, hours, availability, travel times, nightly rates) are accurate to the best of our knowledge when the plan is built, and can change by the time you go. Confirm time-sensitive details (reservations, tickets, hours, rates) directly with the venue before you rely on them.

Budget figures in plans are good-faith estimates, not quotes. Your actual costs depend on your choices and the vendors' current prices.

6. Third-Party Venues and Vendors

Restaurants, hotels, venues, activity providers, and other vendors named in our plans are independent businesses. We don't own, operate, control, or guarantee them. We are not responsible for their pricing, availability, service, safety practices, cancellation policies, or anything else about your experience with them.

When you book, purchase from, or visit a vendor, that relationship is directly between you and the vendor, under their terms. Any dispute about a vendor experience belongs with the vendor, though we always want to hear about it, so future plans get better.

7. Activities and Travel Are at Your Own Risk

Plans may suggest physical activities (hiking, boating, skating, climbing, swimming, and more) and travel (road trips, flights, international destinations). You are the judge of what's right for you: your health, abilities, comfort level, equipment, and circumstances.

For travel, you are responsible for your own documents and requirements (passports, visas, insurance, vaccinations, local laws, and advisories), and for checking conditions before and during your trip.

By using our plans, you accept that you participate in suggested activities and travel voluntarily and at your own risk, and you agree that Big Moments is not liable for injuries, losses, delays, cancellations, or damages arising from activities, venues, vendors, or travel that a plan suggested.

8. Your Content

The photos, videos, voice notes, answers, notes, and other content you upload or submit remain yours. You give us a limited license to host, process, and use that content to operate your account and provide our services; most importantly, to build your plans and assemble your keepsake scrapbooks.

We will not use your uploads in our marketing without your permission (see the Privacy Policy for details).

You agree not to upload content that is unlawful, that infringes someone else's rights, or that you don't have permission to share. We may remove content that violates these Terms.

Keepsakes shared as web pages live at long, unguessable addresses. Anyone with the exact link can view that keepsake, so share your links thoughtfully.

9. Acceptable Use

You agree not to:

  • Use our services for anything unlawful, deceptive, or harmful
  • Attempt to access accounts, systems, or data that aren't yours
  • Scrape, copy, resell, or redistribute our plans, content, or services
  • Interfere with the operation or security of the website
  • Misrepresent who you are or your relationship to another person
  • Use the services to harass, stalk, or harm anyone, including the person a plan is about

10. Our Content

The Big Moments website, brand, copy, designs, questionnaires, and the plans we create are our intellectual property (or used with permission). Your plan is licensed to you for personal, non-commercial use: enjoy it, share it with your partner, live it. Don't resell it, republish it, or use it to build a competing service.

11. Businesses and Teams

Partner offers submitted by venues are inquiries, not agreements; nothing is promised or published until we've agreed on details together. Employee-benefit purchases are governed by these same Terms; each employee's plan is built from what the employee chooses to share with us, and allowances and refund rules apply the same way.

12. Disclaimers

Our services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We don't warrant that the website will be uninterrupted, error-free, or secure, or that any plan will produce a particular outcome. (We plan great nights. The magic between you two is your department.)

13. Limitation of Liability

To the fullest extent permitted by law, Big Moments Company will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from or related to your use of our services.

To the fullest extent permitted by law, our total liability for all claims arising out of or relating to these Terms or our services is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) fifty dollars ($50).

Some jurisdictions don't allow certain limitations, so some of the above may not apply to you. In those places, our liability is limited to the smallest amount the law allows.

14. Indemnification

You agree to indemnify and hold Big Moments Company harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your content, or your misuse of the services.

15. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Any dispute that can't be resolved informally will be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania, and you consent to their jurisdiction.

Talk to us first: email questions@bigmomentscompany.com and give us thirty days to make it right before filing anything. Most problems are one honest email away from solved.

Any claim must be filed within one year after it arose, or it is permanently barred, to the extent the law allows.

16. Termination

You can stop using Big Moments and cancel your membership anytime. We may suspend or terminate access if you violate these Terms, abuse the service or our team, or where required by law. If we terminate without cause, we'll refund the unused portion of any prepaid period.

Sections that by their nature should survive termination (like your content license for delivered keepsakes, disclaimers, limitations of liability, and dispute terms) survive.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the date at the top and take reasonable steps to notify you, like a notice on the site or an email. Continuing to use our services after changes take effect means you accept the updated Terms.
